US citizen shot five times by Border Patrol agent in Chicago sues the federal government
Marimar Martinez's lawyers say a scene reconstruction shows she was not driving at the agent, as he claimed.
Marimar Martinez, a Montessori teaching aide shot by agent Charles Exum during Operation Midway Blitz in October 2025, filed a Federal Tort Claims Act suit on Monday, Oct. 5. Prosecutors had charged her with trying to ram officers, then dropped the case.
- Claims: negligence, battery, assault, false arrest, false imprisonment and malicious prosecution
- Her lawyers are also urging criminal charges against Exum
- Attorney Michael Gallagher: "She almost lost her life as a result."
